Privacy Policy for AtivHealth

This Privacy Policy explains how Accretive Systems LLC ("we," "our," or "us") collects, uses, discloses, and protects the personal information of users of AtivHealth, our personal health record service available through ativhealth.com.

1. Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information").

We collect the following categories of personal information from AtivHealth users:

• Identifiers (Name, email address, phone number, account name, unique personal identifier)
• Personal information categories listed in the California Customer Records statute (Name, address, telephone number, medical information)
• Protected classification characteristics under California or federal law (Age, gender)
• Internet or other similar network activity (Browsing history, search history, information on a consumer's interaction with a website or application)
• Inferences drawn from other personal information (Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes)

2. Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following purposes:

• To provide, support, personalize, and develop AtivHealth.
• To create, maintain, customize, and secure your account with us.
• To provide you with support and to respond to your inquiries.
• To personalize your AtivHealth experience and to deliver content and product offerings relevant to your interests.
• To help maintain the safety, security, and integrity of AtivHealth.
• For testing, research, analysis, and product development, including to develop and improve AtivHealth.
• To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

3. Sharing Personal Information

If you choose to collaborate with a healthcare provider using our shared journal or chat features, we will share your personal profile information, such as your full name, profile image, email address, and phone number with that provider. This sharing only occurs if you explicitly opt in to the collaboration.

We do not share your personal information with data aggregators or for advertising purposes.

4. Your Rights and Choices

You can access and edit most of your basic account information right in AtivHealth by clicking on your profile image and navigating to your profile settings.

If you want to delete your account or any specific information, please contact us by mail at the address provided at the end of this policy.

We do not currently offer a self-serve tool to download a copy of your records. If you would like a copy of your AtivHealth data, please contact us by mail with your request.

5. Information from Others

We may receive contact information about you from other AtivHealth users if they upload their contacts.

We do not receive data from advertisers to target or measure ads.

6. How We Use Information

We use the information we collect to provide you with personalized products and services. This includes:

• Operating, delivering and maintaining AtivHealth
• Personalizing your experience and giving context
• Developing and improving features, algorithms and machine learning models
• Analytics and research
• Enhancing safety and security
• Contacting you
• Providing support
• Enforcing our terms and policies

7. How We Share Information

We may share your information in the following ways:

• With other AtivHealth users you designate, such as family members or doctors, if you choose to collaborate with them using our shared journal or chat features
• With service providers who help us operate AtivHealth
• With affiliates within our corporate family
• For the purposes of a merger or acquisition

We do not share your health records or profile information publicly. We also do not share personal information with business partners for advertising or with anti-fraud partners.

8. How Long We Keep Your Information

We keep your information as long as you maintain an AtivHealth account, and otherwise as long as we need it to provide AtivHealth, or as required by law. Specific retention periods depend on the type of information and how it is used.

We consider factors like whether we need the information to operate or provide AtivHealth, to comply with legal obligations, to prevent harm, or to investigate violations of our terms and policies.

In some cases we are required by law to retain information, such as if we receive a valid legal request. Information may also be kept in backup systems for a limited period.

9. Updates to the Privacy Policy

We may update our Privacy Policy from time to time. When we do, we'll revise the date at the top of the Privacy Policy and provide you with additional notice, such as adding a statement to our homepage or sending you an in-app notification.
